this is unbelievable how can anyone stay safe this guy brke some ones wifi code in 2.33mins and if the owner of that connection recieves a letter by a law firm... well he can join us

Just holding my LOD off for a bit .. still a few issues I'm waiting on to see how they play out namely the Data protection thing and see if the press picks up on it .

Well I've had a call from Watchdog wanting me to forward the letter on so they can investigate this further. I believe this is going to be big... I've scanned the letter and sent it via email in PDF format..

I urge everyone to do the same as it looks like this has hit the press bigtime looks like a lot of people are calling in about it.... heres what I wrote in my email

Hi,

In reply to the voicemail Claire left me on my mobile I'm attaching the ACS Law Letter which I received in the post on the 07/05/09 which I have 21 Days to respond.


The letters that are flooding through everyone's door at this present time are claiming that we have breached copyright infringement against a company called Topware Interactive game title: Dream Pinball

I have no aknowledgement of downloading any such game and this has caused a lot of stress keeping me up late at night trying to research the so called ACS Law:


I have now less than 21 Days to respond to this letter and they are forcing me to pay £665 Or they will take out a court summons. You will see that many ISPS have been taken to court by ACS LAW and have been forced to pass on our details surely against the DPA?

I have enclosed this link which may provide useful as their are a lot of people out there in the sameboat.

Today I have been mostly trying to obtain information from ACS:Law as to there registration (or lack of it) with the ICO as data controllers under the DPA, I seem to be getting somewhere at last, but it been a real effort, its been impossible to get anything out of them on the phone but I finally found a way to get them to respond, more details to follow. not sure I want to post it here at the moment.

I have also had a call back from Claire at Watchdog like snookersport, so hoping that will run with the story

Have included a link with regards to Bit Torrent as a file sharing programme, it maybe of some use to you people. My partner is in the same position as you, at present we are sitting and reading these threads.

I have jumped on her daughters pc and ripped the thing to shreds checking registries and log files and i cannot find any trace of two world on her pc..

There is some terrific information which has been posted on here, its nice to see a community thriving and working together to resolve such a cheap trick especially in the current climate..

Unhappy ACS : Law - Call of Juarez letter

The dreaded letter arrived yesterday, and already I can see how dodgy this is. Before I discovered this forum (I registered minutes ago) I had already seen articles on Logistep and Davenport Lyons.

Also my other half remembers the Watchdog show about this situation.

I am drafting my first reply now, think I will mention the CDA 1988. I have until 26th May to hit the 21 day deadline so I have some time to work on it.

I have seen the draft letter in page 13 but I am a bit nervous of the "see you in court" section as it seems this Andrew Crossley is no stranger to the courts.

The daft is I once played a demo of this game about a year before the alleged "infringement" and thinking it was a bit crap.

I do remember though at one point I had to block several devices showing on my internet router's list as they did not belong to me or anyone else living here. That said there is nothing on the ACS letter that actually identifies a specific user or device.

Sorry if my post seems a bit erratic or annoying, just a bit nervous about the situation especially as I presume ACS will have learnt from Davenport Lyons.

Hi There, last post new memeber please pass your details scan your letter and send it to Watchdog as they are starting to call people about this fiasco.

when I received my letter and before I found this forum I responded by email denying the allegations and asking for further proof.

Today I received this reply

Yes its just their standard template response when they dont know what to do next, and cannot answer because they need to work out how best to threaten you next.

I still LOL when I read "No further action will be taken by us against you in the meantime" hmm perhaps that because they dont actually have any evidence to take any action.

Welcome laststand

Please do not be intimidated by these people, use the template letter, there is also a more complete version posted a few days ago. These people will try to threaten you and will continue to threaten you, don't be tempted to get into a discussion on anything eg someone may have hacked my WiFi etc etc at this stage thats for defense filing stage only (if it ever gets to that.)

These people only understand strong words, show no weakness, we need to be saying put up or shut up, this normally does the trick (eventually) especially considering they are only supposed to send a maximum of 2 letters if you still deny at this stage they should not write to you again they either should shut up or issue legal proceeding (which they have never done so far) if they continue to write they can be reported to the SRA as this is considered harassment.

Do not fear them this is what they are depending on by striking fear into people.
