With regards to the court hearings we as a group were very lucky.
I'm not sure how to look at the future schedule of appointments and hearings to search for Topware. We only knew of the one case being heard, and it was purely by happenstance that they started talking about two more cases, though they did not mention the ISPs involved - except to mention Virgin Media at one point.
I'll be there on June 8th to carry on listening and observing Mr Crossley subvert the justice system with his false information, and I invite others to do the same. I think that if 6 of us showed up, and quietly took the seats at the back this would prove VERY interesting. Closer to the date I will give clear details on how to find the room in the Royal Courts of Justice, as it's labarynthine layout takes a few minutes to navigate.

I will try again later to search the listings for Topware, and encourage everyone else to do the same to see if we collectively have more luck.

The more active we are, the more opportunities like this will arise.

Excellent letter, would you mind if I used this as a template for my own letter? I realise that we should do our own BUT I have such a mental block that when I read quality like yours it stops me writing anything lol

Was at work yesterday and couldn't catch up on all the posts until today but its fantastic the information everyone is putting together.

I so glad that I found this forum otherwise id be in a padded cell rocking back and forth by now.

Just out of interest has anyone been in contact with a national newspaper as they might well be interested, exspecially with watchdog covering similar last year.

Just a little point about the template letters I've seen so far: The first reply from DL for those kind of letters has been along the lines of "oh well, we're not accusing you of anything, just holding you responsible for it".

It would be well worth anticipating this in the first letter and telling them this is legal gibberish - as the CDPA 1988 requires you to directly infringe copyright or authorise someone else to do so. Let them know that you know you're not being accused as they haven't a scrap of evidence you did anything and therefore they should take a hike. Obviously you've been a victim of foul play.

However, those letters sent so far seem fine. Good job. You can make that point to them in the next letter (as rest assured they will reply) and inform them you've said all that you can reasonably say, you're probably a victim of foul play and you'll see them in court (or words to that effect). Hopefully the pay up rate will be enough that they won't ever bother.
Thanks for all your efforts Penumbra, I tried to register with slyk but did not seem to be able. I think I ballsed up my registration so I am delighted you have posted here.

Thanks for this BeingScammed.

So the other two caes were related to TopWare too?

Also, and I'm not trying to be clever here...but what do you mean that we as a group were lucky? Lucky that yesterdays case was adjourned, or lucky in that we have the inside scoop?
Cheers again

For Concernedaboutmyprivacy - Lucky that someone spotted the posting of the hearing, as far as I can tell they change that page daily, and I haven't been able to see a future hearings list as of yet.

So people know where the court is, I suggest you bookmark this page for closer to the date (I will link this page then also).

The Royal Courts of Justice, Strand, London, WC2A 2LL
Her Majesty's Courts Service - Court Information and Addresses

The busses are probably the easiest way to get there. Just take any bus to Aldwych (too many to list, and they come from every direction through this transport hub) and walk 2 mins to the RCOJ.

The room for the hearing (and seems to be the resident room for Master Winegarten) was in the Thomas Moore Building, on the 7th floor.
You need to allow 10 minutes or so from arriving at the RCOJ to get to the room. After entering the main entrance of the RCOJ, go through the security area (usual checking for guns etc), then you will see large display cases of the listings. Check the listings for the right room, as even on the day things can change. Ahead you will see a large pictorial map of the grounds with coloured buildings. The Thomas Moore Building (hence the TM notation for the room number) is located on the west side of the grounds. Head further into the main building and you will see the first of many signs indicating "Thomas Moore Building This Way". I think there was about 6 of them before I finally got there - like being on Sesame Street. Up the elevators, following the signs for the location of the room. Then so that we respect Master Winegarten, to wait in the waiting room adjacent (as indicated on the signs). A green light will show when it's time to quietly enter.

Master Winegarten as full rights to limit the number of people in attendance, because although it is a public hearing, if there are too many people there it may "interfere with the course of the proceedings". That's why I suggest 6 people - respectful but a definite presence =)

Now to email some more lawyer friends and see what they think of all this.

something interesting i've found about CDPA 1988(particularly sections 16(1)(d) & 20:
footnote: Revised s 16(1)(d)substituted by SI 2003/2498 (replacing original wording:"to broadcast the work or include it in a cable programme service(see section 20)"
s20 also substituted by SI 2003/2498

see this:
Code:
http://products.ihs.com/Ohsis-SEO/593720.html
read carefully section(i) it sais wilfully infringes copyright.....

if alleged infringment took place without our knowledge or consent(unsecured wifi, hackers etc) how can it be wilfull?

Default David Lammy MP

Interesting reading
'Internet pirates beware: this man is out to stop you' - by Richard Wray in the Observer.: David Lammy MP for Tottenham
Although how the general public might view this as Mr Lammy helping people like ACS enforce their stance - it is not. Mr Lammy is obviously a diplomat and will not stand for rogues like ACS endangering the whole process and the fine balance between ISPs, Individual users and the creative artists.

I have just emailed him as much, so there's another pebble in the pond.
